These Terms of Service and Terms of Purchase (“Terms”) govern your access to and use of the Maison Tamkin website, online store, digital products, free resources, waitlists, email-related services, and other services made available by Maison Tamkin (collectively, the “Services”).

Maison Tamkin is based in Québec, Canada. Our online store is powered by Shopify.

By accessing or using the Services, creating an account where available, submitting information through the Services, or purchasing a Maison Tamkin product, you agree to these Terms to the extent permitted by applicable law.

If you do not agree to these Terms, do not use the Services or purchase a product.

1. About Maison Tamkin

Maison Tamkin provides digital educational products, resources, and related content.

Maison Tamkin currently operates primarily through digitally delivered products and resources. Unless expressly stated otherwise for a particular offer, no physical product will be shipped.

Maison Tamkin’s current digital products are designed primarily for adult users.

Contact information is provided in Section 24 below.

2. Eligibility and Use of the Services

You may use the Services only where you are legally capable of entering into the relevant transaction or agreement under applicable law.

Maison Tamkin’s products and Services are intended for adults.

By making a purchase, you represent that:

• the information you provide is accurate and complete;
• you are legally permitted to use the payment method provided;
• your purchase and use of the Services do not violate applicable law;
• you will use Maison Tamkin products only as permitted by these Terms.

You are responsible for maintaining the confidentiality of any account credentials or access information associated with your purchase.

3. Digital Products

Maison Tamkin sells digital products, which may include:

• digital guides;
• ebooks or downloadable documents;
• workbooks;
• educational materials;
• digital programs;
• templates or tools;
• private digital resources;
• other electronically supplied materials.

The precise contents of each product are described on the applicable product or sales page.

Maison Tamkin may use third-party platforms, applications, cloud services, download links, customer accounts, or other technologies to provide digital access.

No physical shipping should be expected unless Maison Tamkin expressly identifies a product as physical.

4. Orders and Contract Formation

Products displayed on the Maison Tamkin website constitute invitations to place an order unless applicable law provides otherwise.

When you submit an order, you are offering to purchase the identified product subject to:

• these Terms;
• the applicable product description;
• the price shown at checkout;
• the Return and Refund Policy;
• any specific terms clearly disclosed before purchase.

Maison Tamkin may decline or cancel an order where reasonably necessary, including where:

• payment cannot be authorized;
• information appears incorrect or incomplete;
• fraud or unauthorized activity is reasonably suspected;
• a pricing or technical error has occurred;
• fulfillment is legally prohibited;
• a product is unavailable because of an unexpected technical issue.

Where Maison Tamkin cancels a paid order that has not been fulfilled, amounts paid for that order will be refunded as appropriate.

For Québec consumers and other customers protected by mandatory distance-contract rules, nothing in these Terms limits information, contract-copy, cancellation, or other rights that cannot legally be waived.

5. Prices, Currency, Taxes, and Payment

Product prices are displayed in the currency identified on the website or at checkout.

Unless expressly stated otherwise, applicable taxes may be calculated or added at checkout in accordance with the customer’s location and applicable law.

You are responsible for reviewing the total purchase price before submitting your order.

Payments are processed through Shopify Payments or other payment providers made available through the store.

Maison Tamkin does not ordinarily receive or store your complete payment-card number.

Your bank, card issuer, payment provider, or other third party may impose charges, currency-conversion costs, or other fees that are outside Maison Tamkin’s control.

Digital products may be subject to different tax rules depending on customer location.

6. Digital Delivery and Access

Digital products may be delivered or made accessible through:

• an email;
• a download link;
• a customer account;
• a digital library;
• a third-party platform;
• another electronic access method identified at purchase.

Delivery may occur immediately after payment or within the timeframe disclosed before purchase.

You are responsible for providing an accurate email address and maintaining reasonable access to the email account or other credentials associated with your purchase.

If you purchase a product but do not receive the promised digital access, contact Maison Tamkin so that the delivery or access issue can be investigated.

Maison Tamkin may modify the technical delivery method without materially reducing the product that you purchased.

7. Returns, Refunds, and Cancellation

Maison Tamkin’s digital products are subject to the Return and Refund Policy.

Except where applicable law requires otherwise, sales are final once digital access or delivery has begun.

A change of mind, failure to use the product, or failure to achieve a particular personal result does not ordinarily create a right to a refund.

Nothing in these Terms or the Return and Refund Policy excludes mandatory rights concerning defective, inaccessible, non-conforming, incorrectly delivered, or otherwise legally protected digital content.

Where applicable law provides a statutory cancellation or withdrawal right for digital content, any waiver or loss of that right will apply only where the legal requirements for doing so have been satisfied.

8. Personal License to Digital Products

Unless a product page expressly provides different rights, purchasing a Maison Tamkin digital product grants you a limited, personal, non-exclusive, non-transferable license to access and use that product for your own personal use.

Purchasing a product does not transfer ownership of Maison Tamkin’s intellectual property to you.

You may not, without prior written authorization from Maison Tamkin:

• reproduce a product for commercial distribution;
• resell, sublicense, rent, or redistribute a product;
• share purchased access with people who did not purchase or otherwise receive authorized access;
• upload paid materials to public or shared repositories;
• copy substantial portions for publication elsewhere;
• translate, adapt, repackage, or create commercial derivative products from Maison Tamkin materials;
• remove copyright, trademark, attribution, or proprietary notices;
• use Maison Tamkin materials to create or train a competing paid product, database, course, guide, or commercial resource.

Reasonable personal use, including personal note-taking, printing for your own use where technically permitted, and other use consistent with the product’s intended purpose, is allowed.

9. Intellectual Property

Unless otherwise stated, the Services and their contents are owned by or licensed to Maison Tamkin.

This may include:

• written material;
• educational frameworks;
• product architecture;
• graphics;
• branding;
• product names;
• photographs;
• videos;
• audio;
• downloads;
• templates;
• website copy;
• design elements;
• proprietary methods and organizational systems.

Maison Tamkin retains all rights not expressly granted under these Terms.

“Maison Tamkin,” “Tamkin,” applicable product names, and associated brand assets may be protected by intellectual-property laws regardless of whether a particular trademark registration has been obtained.

Nothing in these Terms grants permission to use Maison Tamkin branding in a way that suggests endorsement, partnership, affiliation, or authorization where none exists.

10. Educational and Health Information

Maison Tamkin operates in a health-adjacent educational space.

Maison Tamkin products, including Tamkin: Body Literacy, are provided for general educational and informational purposes.

They do not constitute:

• medical diagnosis;
• medical treatment;
• personalized medical advice;
• psychological or psychiatric treatment;
• dietetic or nutrition therapy;
• individualized supplement prescribing;
• individualized clinical care;
• a substitute for care from an appropriately qualified professional.

Maison Tamkin does not establish a doctor-patient, therapist-client, dietitian-client, coach-client, or other individualized professional-care relationship with you merely because you purchase or use a product.

Information concerning symptoms, cycles, supplements, herbs, food, body literacy, laboratory testing, healthcare conversations, or other wellness topics is educational and should be interpreted within the context and limitations stated in the relevant product.

You remain responsible for your own decisions and for seeking appropriate professional care where necessary.

If you have an urgent or emergency health concern, seek appropriate emergency or professional assistance rather than relying on a Maison Tamkin product or communication.

11. No Guarantee of Individual Results

Maison Tamkin does not guarantee that using a product or following educational information will produce a specific:

• health outcome;
• symptom change;
• menstrual or hormonal outcome;
• laboratory result;
• diagnosis;
• treatment outcome;
• financial result;
• personal transformation;
• or other individual result.

Bodies, circumstances, implementation, medical conditions, professional care, and individual responses vary.

Testimonials, examples, founder observations, educational examples, or descriptions of possible outcomes do not constitute guarantees that you will experience the same result.

12. No Individualized Coaching or Health Support

Unless Maison Tamkin expressly sells a separate service stating otherwise, purchases are self-led.

Reasonable assistance with matters such as:

• payment;
• order identification;
• access;
• download issues;
• technical delivery;

does not create an obligation for Maison Tamkin or Mame Awa Traoré to provide individualized coaching, personalized health guidance, product interpretation, or ongoing one-to-one support.

13. Acceptable Use

You must not use the Services to:

• violate applicable law;
• infringe intellectual-property or privacy rights;
• distribute malware or harmful code;
• gain unauthorized access to systems or accounts;
• interfere with website security or normal operation;
• scrape or systematically extract protected content for unauthorized commercial use;
• impersonate another person;
• engage in fraud or payment abuse;
• misuse promotional offers, access credentials, or digital-product links;
• use Maison Tamkin materials in a way prohibited by Sections 8 and 9.

Maison Tamkin may restrict access where reasonably necessary to protect the Services, customers, intellectual property, payment systems, or legal rights.

14. Shopify and Shopify Network Intelligence

Maison Tamkin’s online store is hosted and powered by Shopify.

Shopify processes information relating to visitors and customers in order to provide ecommerce infrastructure and other services to Maison Tamkin.

Shopify Network Intelligence is enabled for Maison Tamkin.

When Shopify Network Intelligence is enabled, Shopify may process information relating to your interactions with Maison Tamkin together with information relating to interactions with Shopify and other Shopify merchants in order to provide Enhanced Services.

These services may support functions such as:

• personalization;
• improved products and store performance;
• fraud detection and prevention;
• measurement and understanding of customer interactions;
• advertising or advertising relevance where permitted.

Information relating to your activity on Maison Tamkin may be shared with or processed by Shopify and other service providers, including parties located in countries other than your own, in connection with these services.

Other Shopify merchants do not thereby receive direct access to Maison Tamkin’s customer database.

Shopify may process certain information in its own capacity as described in Shopify’s privacy documentation.

15. Privacy

Maison Tamkin’s processing of personal information is described in the Maison Tamkin Privacy Policy.

By using the Services, you acknowledge that personal information may be processed by Maison Tamkin and relevant service providers as described in that policy and subject to applicable law.

Privacy choices and rights vary by jurisdiction.

16. Third-Party Services and Links

The Services may contain or rely on third-party platforms, applications, payment services, websites, or links.

Maison Tamkin does not control independent third-party services and is not responsible for their separate terms, privacy practices, availability, or content, except to the extent responsibility cannot legally be excluded.

Your use of an independent third party may be subject to that party’s own terms.

17. Product and Service Changes

Maison Tamkin may update, improve, reorganize, correct, or discontinue aspects of the website or Services.

For purchased products, Maison Tamkin will not intentionally remove materially promised paid content in a manner that violates applicable consumer law.

Updates may include:

• correcting errors;
• improving clarity;
• updating references;
• changing delivery technology;
• maintaining security;
• making legally required changes.

A purchase does not create a right to every future Maison Tamkin product, update, feature, edition, bonus, service, or offering unless the applicable sales page expressly included it.

18. Availability and Technical Interruptions

Maison Tamkin aims to provide reliable access but cannot guarantee uninterrupted or error-free operation at all times.

Temporary interruption may occur because of:

• maintenance;
• hosting issues;
• internet outages;
• third-party service interruptions;
• security incidents;
• platform changes;
• circumstances outside Maison Tamkin’s reasonable control.

Where a technical problem materially prevents access to a purchased product, Maison Tamkin will take reasonable steps to restore or otherwise provide the purchased access, subject to applicable law.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an “as available” basis.

Maison Tamkin does not make warranties beyond those expressly stated in the applicable product description or those that cannot legally be excluded.

Nothing in this section excludes statutory warranties, guarantees, conformity rights, or other mandatory consumer protections that apply to you.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Maison Tamkin will not be liable for indirect, incidental, special, consequential, exemplary, or purely economic losses arising from use of the Services where such liability may lawfully be limited.

Where liability may lawfully be limited, Maison Tamkin’s aggregate liability arising from a particular purchased digital product will not exceed the amount actually paid for that product.

These limitations do not apply where liability cannot legally be excluded or limited, including where applicable law protects claims involving fraud, intentional misconduct, certain forms of negligence, bodily injury, statutory consumer rights, or other non-excludable liability.

Nothing in these Terms is intended to deprive a consumer of mandatory legal remedies.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Maison Tamkin harmless from third-party claims, losses, or reasonable costs arising directly from:

• your unlawful use of the Services;
• your material breach of these Terms;
• your infringement of another person’s intellectual-property or other legal rights;
• your unauthorized commercial redistribution or misuse of Maison Tamkin products.

This provision does not require you to indemnify Maison Tamkin for Maison Tamkin’s own unlawful conduct or for liability that cannot legally be shifted to you.

22. Suspension and Termination

Maison Tamkin may suspend or terminate access to the Services where reasonably necessary because of:

• material violation of these Terms;
• fraud;
• chargeback abuse;
• unauthorized distribution;
• security threats;
• unlawful activity.

Where legally required, Maison Tamkin will respect applicable consumer rights concerning purchased access.

Termination does not eliminate provisions that by their nature should continue to apply, including intellectual-property rights, payment obligations already incurred, dispute provisions, and legally appropriate liability provisions.

23. Governing Law and Mandatory Consumer Protections

These Terms and Maison Tamkin’s operations are governed by the laws applicable in Québec and the federal laws of Canada applicable there, without excluding mandatory consumer protections that apply because of your place of residence or the circumstances of your purchase.

Nothing in these Terms requires a consumer to waive rights that cannot legally be waived under applicable law.

If a dispute arises, the parties are encouraged to attempt reasonable direct resolution before commencing formal proceedings where appropriate.

Nothing in this section limits your right to use a court, regulator, consumer-protection authority, or other remedy available under mandatory applicable law.

25. Changes to These Terms

Maison Tamkin may update these Terms where reasonably necessary to reflect changes in:

• the Services;
• products;
• technology;
• business operations;
• service providers;
• applicable law;
• regulatory requirements.

The “Last updated” date will be revised when these Terms are updated.

Changes will not retroactively remove rights that have already accrued where applicable law prevents that.

Where legally required, additional notice or consent will be provided.

26. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be interpreted or limited to the minimum extent necessary where legally possible, and the remaining provisions will continue in effect.

27. No Waiver

A failure by Maison Tamkin to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or of the right to enforce it later.

28. Entire Agreement

These Terms, together with:

• the applicable product or sales page;
• the Return and Refund Policy;
• the Privacy Policy;
• any specific purchase terms disclosed before checkout;

constitute the applicable agreement concerning your use and purchase of Maison Tamkin Services, subject to mandatory applicable law.

If specific product terms conflict with these general Terms, the more specific terms govern for that product to the extent permitted by law.
